This is the Deepmist Studios Privacy Policy (the “Privacy Policy” or “Policy”). It sets out how Deepmist Studios (“Deepmist”, “we”, “us”) may collect, use, share and protect information. In different countries there are different definitions of “personal information” and “personal data”; in this Policy we use “information” to refer to any information that can be used to identify an individual.
This Policy applies to your use of our games, apps, websites and products, to deepmist.com, and to any other services we provide, such as our customer support and any communications we have with you (together the “Service” and “Services”). It forms part of, and should be read alongside, our Terms of Service.
The sections below set out the different types of information we may collect, how we may collect and use it, who we may share it with, and the rights you may have. You are under no legal obligation to provide your information to us. If you would rather we did not collect or use information as described in this Policy, you should not use the Services. We are the controller of the information described in this Policy, and you can reach us at any time using the details in the Contact Us section below.

Our Games
This Policy applies to all games and apps published by Deepmist Studios, whatever their name and however they are distributed — including games we released before this Policy and any we release after it — together with deepmist.com and our related support services. Our games may be played through an app store, through a website, or through a third-party platform.
When you use one of our Services, such as playing one of our games or contacting us, we may collect information about you. Most of this information comes directly from you or from your device.
Information We Collect
When you download and play one of our games, visit our websites or use our other Services, we may collect information about you. We may collect it to create and maintain an account where a game offers one, to enable and improve gameplay, to enable in-app purchases where a game offers them, to provide technical support, and for the other purposes explained in this Policy.
The information we collect depends on how you use and interact with our Services. It may include information you give us, such as an email address or other details you choose to provide. It also includes technical information about the device you use, such as your device type and IP address. In addition, it may include information about your gameplay, such as your progress within a game. We may also receive some information from third parties, for example where you sign in to one of our games using another service.
How we may collect your information
There are a variety of ways in which we may collect information about you. Generally we collect it directly from you or automatically from your device, though some third parties may also provide us with information. Examples of the ways in which we may obtain information include:
- from your registration, sign-up and sign-in to our games, where a game offers accounts;
- from your gameplay and other activity on the Services, such as session length, progress and other in-game events;
- from integrations with app stores, platforms and social networks;
- from advertising partners and from adverts you interact with;
- from payment providers, to process in-app purchases and subscriptions;
- from your interactions with us, including our customer support;
- from in-game chat, messaging and other social features, in games that offer them;
- from marketing activities such as surveys, contests, sweepstakes and events; and
- from other players, for example where somebody invites you to play.
What information we may collect
The information we collect depends on how you use and interact with our Services. When you use the Services, we may collect and process information such as:
- a username, display name or other name you choose;
- an avatar or profile picture, if you choose to provide one;
- your email address;
- biographic details you provide, such as your age, date of birth or country;
- your name, where you choose to give it to us, for example when you contact us;
- the approximate location from which you access our Services;
- details about the device you access our Services from, such as your IP address, device model, operating system and version, language, time zone, network type and app version;
- advertising identifiers provided by your device, such as the Identifier for Advertisers (IDFA) on iOS and the Google Advertising ID (GAID, also written AAID) on Android, together with other app and device identifiers;
- your account activity, progression, scores, in-game items, virtual currency balances and status;
- records of purchases, subscriptions and refunds, such as what was bought and when;
- diagnostic information, such as crash reports, error logs and performance measurements;
- information about adverts, such as whether an advert was offered, shown, watched or clicked;
- information you provide to help us confirm your identity or recover access to an account;
- information you share directly with us, for example in a support request, a contact form, a survey or a competition entry; and
- information collected through your gameplay, for example how often and when you play, which features you use, and how you interact with other players.
Some of our games may allow you to create content, send messages or otherwise communicate with other players. Where a game offers this, we may collect and process the content you create or send, and information about it, including for moderation and safety purposes.
Information we may receive from third parties
We may also receive information from third parties who share it with us, including:
- Platforms and sign-in services. Some of our games may allow you to register or sign in using a platform or third-party account, such as Apple, Google, Game Center, Google Play Games or a social network. Where you do, that service may pass information to us, such as your identifier for that platform, your display name, your profile picture, your friends list or the identifiers of friends who also use our Services, your email address, and any other information you or the service choose to share with us. If you are unsure what a third party shares with us, please consult its privacy policy and your account settings there.
- Payment and store services. Third parties that provide in-app purchasing or payment services — for example Apple, Google or other payment processors — may tell us what has been purchased, when, and whether a purchase was refunded, and may in some cases provide additional information given at the point of purchase. For further details about payments, please see our Terms of Service.
- Advertising, attribution and measurement partners. These partners may provide information about your device, browser or activity, such as device type, operating system and version, the number of clicks on an advert or feature, which pages or screens were viewed, how long was spent on them, and which campaign or source an installation came from. We may connect this information with other information we hold about you.
- Analytics and other service providers, which may provide reports about how our Services are used and how they perform.
- Other players, for example where a friend or family member shares your information in order to invite you to our Services. They are responsible for obtaining your permission before doing so.
We may also occasionally operate online or in-person events, activities or initiatives (“Events”). If you register for or attend an Event, we may collect information such as contact details, photographs or recordings taken during the Event, information about your attendance and any gameplay you take part in, and other information needed to run the Event.
Why We Collect Information, and What We Do With It
We may collect information for various purposes, including to create and maintain accounts where a game offers them, to enable, personalise and improve gameplay, to enable in-app purchases where a game offers them, to provide technical support, to allow you to connect and communicate with other players where a game offers this, to tailor advertising in games that show adverts, and to operate, improve and optimise our Services and our marketing. Not every purpose applies to every game. Below are further details on some of those purposes.
We will only collect and use your information where we have a lawful basis for doing so. There are different lawful bases for collecting and using information, and which of them applies depends on the laws that apply to you based on where you live and where you use our Services from. The most common lawful bases we rely on are:
- Consent — you have given us your consent to a particular use, and you may withdraw it at any time.
- Performance of a contract — the use is necessary to provide the Services you have asked for and to fulfil our contractual obligations to you.
- Legitimate interests — the use is necessary for our or a third party’s legitimate interests, where those are not overridden by your rights and freedoms.
- Legal obligation — the use is necessary to comply with a legal or regulatory obligation.
Account registration and maintenance
Some of our games may offer accounts. We may use information to set up and register an account, to enable you to sign in using different methods, and to manage that account — for example to secure it, to verify your identity, to help you recover access, and to enable its functionality. Where a game offers cloud save or synchronisation across devices, we may use information to store your progress and make it available on the devices you use.
Gameplay
We use information to provide and optimise our games. This may include using information about your gameplay and purchases to tailor a game to you, which may take the form of in-game gifts, offers, promotions and features. We use those parameters because we believe they play a significant role in determining, for example, your level of engagement with our games. We may also use your information in aggregate with other players who have similar backgrounds or gameplay, to help ensure that players have an enjoyable experience.
We may also use your information to track your progress so that we can provide rewards and incentives that are relevant to you and your gameplay, and to maintain the security and integrity of your gameplay — for example to detect cheating, refund abuse, invalid advertising traffic and attempts to interfere with the Services.
In-game purchases
Some of our games may offer in-app purchases, subscriptions, virtual currency or virtual items — for example additional content, in-game items, or an option that removes adverts. We may use information about payments made, through our payment processors, to process your payment, to credit your account with what you have purchased, to handle refunds and disputes, and to meet our accounting and tax obligations. Payment is taken by the relevant store or payment processor rather than by us.
Some of our games may present offers and promotions that are personalised, for example based on your gameplay or purchase history.
Customer support
We may use information to provide support to you directly, or to assist with more general support across the Services, such as bug fixes. If you provide us with information in a support request, a contact form or a similar channel, our support team will use it to assist you, to resolve your issue and to keep a record of what was asked.
Social features and chat
Some of our games may offer social features and chat or messaging functions, such as friends, invitations, teams or clans. We may process information to enable these features, to let you connect with other players, and to keep those features safe — including moderating messages and user-generated content, whether automatically, manually or both. Some of the information we collect or process for these features may be provided by third-party platforms. For more details about how your social media information is shared, please visit your profile settings on that platform and consult its privacy policy.
Some of our games may send push notifications from our servers, for example about your game, an event, or an offer. You can turn these off as described in the Advertising and Marketing section below.
Advertising
We may use information to assist with the integration of advertising into games that show adverts. We may also share your information with third parties, such as our advertising partners, to assist with the functionality, delivery, capping, measurement and targeting of adverts. We may also use information to promote our own games, including cross-promotion between our games and user-acquisition campaigns. Further details are in the Advertising and Marketing section of this Policy.
Business management and analytics
We may use information about you and your gameplay to assist with our business management and business planning. For example, this gives us indications of how players interact with our Services and how we can develop and improve our games, our Services and our marketing. This includes building an aggregate picture of our player base, such as how many people play, how long they keep playing, which countries and regions they play from, which devices they use, and behavioural segments that group players by how they play.
We may also use information to comply with the law, to respond to lawful requests, and to establish, exercise or defend legal claims.
How We Share Information
To provide you with our Services, we may share information about you with our service providers and business partners for analytics, marketing, advertising and other business purposes. Some information about you may also be accessible to other players, for example where a game offers social features.
Information that may be available to other players
You may choose to disclose information about yourself when using our Services. Some features may also integrate with third-party sites or services so that you can communicate with other players.
Any information you provide through these features may potentially be accessed, read, watched, collected and used by us and by other players. We are not responsible for information you choose to make public or to share. Please see our Terms of Service for guidance about posting content through our Services.
To enable some social features, you may be able to import or manually enter information about friends and family so that you can connect with them on our Services or invite them.
In some of our games, other players may be able to see details about you and your gameplay, communicate with you, and access a profile and the information available on it. Where you register or sign in through a platform or social network, some features may share details of your activity with your connections on that service, and a player who invited you may be able to see information about your gameplay.
Service providers and business partners
We use unaffiliated companies to support the Services we provide — for example hosting and content delivery, backend and cloud storage services, analytics, crash and performance reporting, advertising, attribution and measurement, payment processing, customer support, moderation, security, email delivery and event services. These partners process information for the purposes described in this Policy.
The following are among the third parties whose services we may use. This list may change as we release, update and retire games, and not every partner is used in every game. Each partner’s own privacy policy explains what it does with information it collects:

A current list of partners, with links to their own privacy policies and to the opt-out routes they offer, is kept on our advertising and data opt-out page.
Some of our advertising and measurement partners may act as independent controllers of the information they collect through our games, and may combine it with information they hold from other apps and services in order to select and measure adverts. Where that is the case, their own privacy policies govern what they do.
Sale or Merger
If Deepmist Studios seeks or undergoes restructuring of any kind — including a merger, acquisition, financing, reorganisation, bankruptcy, or the sale or purchase of any of our assets, or negotiations towards any of those — we may disclose information we hold, including personal information, to the other organisations involved, and it may be transferred as part of that transaction. We will make reasonable efforts to let you know if this happens and how it affects your information, to the extent required by law.
Publicity and market analytics
We may produce, use, publish and share with our business partners aggregated and analytical information — information about you and other players collectively that is not intended to identify any individual player — and other anonymised information about our players. We may do this for industry analysis, demographic profiling, marketing, analytics, advertising and other business purposes. Where we de-identify information for these purposes, we will not attempt to re-identify it.
Legal obligations and compliance
We may share information to satisfy our legal obligations and to comply with law enforcement. Examples of when we may share information include:
- where we decide in good faith to disclose information in response to a lawful request by a public authority, including to meet national security or law enforcement requirements, or in response to legal process such as a court order, search warrant or subpoena;
- to satisfy laws, regulations or mandatory codes of conduct that require us to disclose details about the information we collect;
- where we have reason to believe that our Services are being used to commit a crime, in order to report or investigate suspected criminal activity, or to share further details with other companies and organisations for its prevention, reporting or investigation — including efforts to prevent fraud and other security precautions, at our sole discretion;
- where we have reason to believe there is an emergency that poses a threat to the health or safety of any person, including our players, our staff or the public, at our sole discretion; and
- to protect the rights or property of Deepmist and of third parties, including to enforce our Terms of Service, or to establish, exercise or defend a legal claim.
Advertising and Marketing
We may use information such as device identifiers and in-game events to run, measure and optimise our marketing campaigns — for example to show adverts for our Services on other websites or apps, and to cross-promote our own games.
In addition, some of our Services include adverts from third-party advertisers, which may be shown in different formats. These advertisers may collect and share some information, such as whether you click an advert, to assist with the functionality and targeting of adverts.
We record whether you have consented to receive promotional and marketing communications from us. If you have consented to receive marketing from us — for example by email — we may use information we have collected about you and your interests, together with your contact details, to send you marketing materials. Some of these materials may also be delivered through our apps or as in-game notifications. We may also invite you to take part in surveys, contests, sweepstakes and similar activities.
Advertising
To assist with the functionality of, and to personalise, the adverts you see on our Services, as well as to run, measure and optimise our own marketing campaigns and to undertake performance analytics, our advertising partners may collect — or we may share with them — types of information such as:
- advert performance information, such as whether an advert was shown, watched, skipped or clicked;
- aggregated or de-identified information about players intended to help target adverts without directly identifying individuals;
- technical information about the device used, such as IP addresses, IDFAs, GAIDs and other device identifiers;
- gameplay activity and in-game events, such as your progress within a game and purchases made; and
- identifiers associated with a platform or social network account, where a game uses one.
Some of this information may be collected using cookies and other tracking technologies. Our advertising partners may use several forms of tracking technology at the same time.
If you click an advert, you may be redirected to a third-party app or website that is not owned or operated by us.
Opting out of emails and push notifications
If you wish to opt out of promotional or marketing communications from us, you can:
- click “unsubscribe” in any promotional email we send, or write to us at support@deepmist.com, to change your contact preferences. Please note that we may still contact you about your account or a request you have made to us; and
- change the settings on your device or browser to turn off push notifications from our Services. Some of our games also offer an option to disable notifications in the in-game settings, and where you have connected a platform or social network account you can usually turn off notifications there as well.
Opting out of tailored advertising
Depending on where you live and where you access our Services from, you may have a right to opt out of third-party tailored advertising. If you wish to do so, please contact us using the Contact Us section below, or use our advertising and data opt-out page.
You may also opt out of tailored advertising by adjusting the advertising settings on your devices:
- iOS — open Settings → Privacy & Security → Tracking and turn off “Allow Apps to Request to Track”, or turn off the permission for an individual app. You can also open Settings → Privacy & Security → Apple Advertising and turn off “Personalised Ads”.
- Android — open Settings → Google → Ads, then choose “Delete advertising ID” or “Opt out of Ads Personalisation”. On some devices this appears under Settings → Privacy → Ads. You can also reset your advertising ID from the same screen.
You may also be able to use industry tools, such as the Digital Advertising Alliance’s “AppChoices” app, to help control the collection and use of cross-app information for tailored advertising. Third-party opt-out tools are independently operated and owned. We do not control, operate or endorse these tools or the choices offered through them; they are listed here as a convenience for players.
Please note that you may still receive adverts within our games even if you opt out of tailored advertising, but those adverts will not be tailored to you. Some of our games may also offer an in-app purchase that removes adverts.
International Transfers
Deepmist Studios is based in Israel, and our partners operate in a number of countries. We may send, access, use or store information outside the country or region where you live, including the United States and Israel. We may transfer information to our service providers, business partners and others as described in this Policy.
Laws vary from jurisdiction to jurisdiction, so the data protection and privacy laws applicable where information is transferred to, stored, used or processed may be different from the laws where you live. When we transfer information out of the country or region where it was collected, we put appropriate safeguards in place, or otherwise take steps to ensure that the transfer meets the legal requirements that apply to it. Information Retention
We may retain information for as long as you use our Services and as necessary to fulfil the purposes for which it was collected, or as necessary to comply with our legitimate business purposes and applicable laws; to comply with legal, accounting, tax or reporting obligations; to resolve disputes; to protect our assets; to run our business efficiently; and to enforce our agreements.
In general, technical, diagnostic and analytics information is kept in identifiable or device-linked form only for as long as we need it, after which it may be deleted or retained only in aggregated form that cannot be linked back to a device or an individual. Account and gameplay information may be kept for as long as an account remains active and for a reasonable period afterwards. Support correspondence is kept for as long as needed to resolve your request and for a reasonable period afterwards. Purchase and transaction records are kept for as long as tax, accounting and audit law requires.
Information Security
We take reasonable steps designed to protect information, including implementing appropriate technical and organisational measures to ensure a level of security appropriate to the risk, and we choose partners who are contractually required to do the same. Access to what we hold is limited to the people who need it.
No method of transmission over the internet, and no method of electronic storage, is 100% secure. We cannot guarantee absolute security, and you send information to us at your own risk.
Links to Other Sites and Apps
Our Services may include links to websites and applications owned or operated by others — for example advertisers, our partners, and the app stores through which our games are distributed.
Any information you provide to a service not owned or operated by us will be subject to the privacy policy of the website or app you have travelled to, and we are not responsible for the content, privacy policy, terms of use or security practices of that site or app. You should review the terms and privacy policy of any site or app you access.
Updates to This Notice
We reserve the right to amend this Privacy Policy from time to time, and we encourage you to consult it regularly for changes. When we update it, we will change the “Last updated” date at the top of this page and post the new version at deepmist.com.
If we make any material change, we will let you know in an appropriate way — for example a notice inside a game — where the law requires it or where we consider it appropriate. If required by law, we will also send a notice to any email address we hold for you.
Children
Our Services, including our apps and games, are not directed to children. We are committed to complying with child protection laws.
How old you have to be
Our Services, including our apps and games, are not directed to children. If you are under 18, you are not permitted to use the Services. In certain games and countries, we may apply an age gate to prevent underage users from accessing the Services.
We recommend that you review our Terms of Service for more details about age guidelines and restrictions on our Services.
We do not sell or share the personal information of anyone we know to be under 16 for cross-context behavioural advertising, and we do not knowingly direct tailored advertising to them.
What an age gate is and how it works
An age gate is a system that can be put in place to prevent users under a certain age from accessing apps and websites, or to ensure that different age groups get an appropriate experience.
If you are playing a game with an age gate that applies in your territory, a prompt may appear asking you to provide information about your age. That information is used to verify that you are old enough to play the game.
If your child has been playing one of our games
We are committed to complying with laws protecting children. If you are a parent or legal guardian and you believe that your child has given us information, or is playing one of our games in breach of our Terms of Service or without your consent, please write to us at support@deepmist.com with enough detail to identify the game and the device — for example the game name and the approximate dates of play. We will take reasonable steps to delete such information as soon as possible.
United States Residents
Several United States state privacy laws require us to give residents of those states additional detail about our practices and additional rights. This section explains those. Where a state law gives you a right described here, you can exercise it whether or not you live in California.
Additional disclosures for California residents
The California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA”), requires us to describe the categories of personal information we collect, the purposes for which we use them, the categories of third parties we disclose them to, and whether we “sell” or “share” them. The following describes the categories of information we may have collected, disclosed, shared or sold in the twelve months preceding the date at the top of this page.
Identifiers — such as IP address, advertising identifiers (including IDFA and GAID), app-instance and other device or account identifiers, a username or display name you choose, and your email address where you provide it.
- Sources: directly from you; automatically from your device and your use of the Services; from third parties, including platforms, analytics partners and advertising partners.
- Business purposes: providing and operating the Services; creating and securing accounts; analytics and product improvement; serving and measuring adverts; security and fraud prevention; responding to requests and support enquiries.
- Disclosed to: our service providers and business partners; and, where a game offers social features, other players.
- Sold or shared: advertising identifiers, IP address and device information may be shared for cross-context behavioural advertising.

Internet or other electronic network activity information — gameplay activity, in-app events, session information, feature use, crash and performance data, and interactions with adverts.

- Disclosed to: our service providers and advertising partners.
- Sold or shared: advert interaction information may be shared for cross-context behavioural advertising.
Geolocation data — generally coarse, city- or country-level location derived from your IP address.
- Sources: automatically, from your IP address; from our partners.
- Business purposes: regional reporting; applying the correct privacy and advertising rules; fraud prevention.
- Disclosed to: our service providers and advertising partners.
- Sold or shared: may be shared, in coarse form, for cross-context behavioural advertising.
Inferences — a profile reflecting preferences or interests, for example about the kind of adverts or in-game content likely to interest you.
- Sources: our analytics and advertising partners; your use of the Services.
- Business purposes: serving and measuring adverts; personalising the game experience.
- Disclosed to: our service providers and advertising partners.
- Sold or shared: may be shared for cross-context behavioural advertising.
Sensitive personal information — some information we may collect could fall within this category, such as account credentials in combination with a password, and the content of messages sent through chat or similar features in games that offer them. We do not use sensitive personal information for the purpose of inferring characteristics about a consumer.
- Sources: directly from you; indirectly from your use of the Services.
- Business purposes: providing, securing and improving the Services; safety and moderation; legal, compliance and regulatory obligations.
- Disclosed to: our service providers.
- Sold or shared: no.
There are categories we would not ordinarily expect to collect through the Services, such as biometric information; audio, visual, thermal, olfactory or similar sensory information; professional or employment-related information; and non-public education information.
We do not sell personal information for monetary consideration. Sharing an advertising identifier with an advertising partner so that adverts can be selected may nonetheless be a “sale” or “sharing” under the CCPA and comparable state laws, and we treat it as such.
We do not sell or share the personal information of consumers we know to be under 16 years of age.
We retain each category for the period described under Information Retention above.
Your rights as a United States resident
Depending on where you live, you may have the right to:
- Know and access — to know what categories and specific pieces of personal information we have collected about you, the categories of sources, the purposes for collecting them, and the categories of third parties we disclose them to, and to receive a copy.
- Delete — to ask us to delete personal information we have collected from you, subject to the exceptions the law allows.
- Correct — to ask us to correct inaccurate personal information we hold about you.
- Opt out of sale and sharing — to direct us not to sell or share your personal information for cross-context behavioural advertising or targeted advertising.
- Limit the use of sensitive personal information — to direct us to limit our use and disclosure of sensitive personal information to what is necessary to provide the Services, where we hold any about you.
- Non-discrimination — we will not discriminate against you for exercising any of these rights. We will not deny you the Services, charge you a different price, or give you a lower quality of service because you made a request.
- Appeal — where your state provides for it, to appeal a decision we make on your request. If your appeal is unsuccessful you may complain to your state Attorney General.
To opt out of the sale or sharing of your personal information, use our Do Not Sell or Share My Personal Information page, or the device-level controls described under Opting out of tailored advertising above. To make any other request, write to support@deepmist.com.
Authorised agents. You may use an authorised agent to make a request on your behalf. We will ask the agent for written proof of their authority and may ask you to confirm directly that you gave it.
Verification. Before we act on a request we may ask for information, documents or other evidence to confirm your identity, so that information is not disclosed, deleted or altered improperly. Where a game has no account, we may hold little that identifies you as a person, and we may need you to give us the relevant advertising identifier or other information that lets us locate the records relating to you. If we cannot verify a request to the standard the law requires, we will tell you why.
Do Not Track
Some browsers can send a “Do Not Track” signal to the websites you visit. There is no common industry or legal standard for what a site must do in response, and Deepmist does not currently respond to “Do Not Track” signals.
Where the law of your state requires it, we honour an opt-out preference signal such as Global Privacy Control (GPC) received by our website as a valid request to opt out of the sale and sharing of personal information for that browser. Cookies, Similar Technologies and Artificial Intelligence
We may use cookies and other technologies to collect information about how you use our Services and our website, to assist us with things like improving the Services and targeting advertising. We may also deploy technology including artificial intelligence for other purposes, such as to provide new features or to assist with the functionality of the Services.
Cookies and similar technologies
A cookie is a small data file transferred to your device for record-keeping purposes. Information contained in a cookie may be linked to other information, such as your browsing activity. We may place cookies on your device, including on deepmist.com and in any in-game or in-app web views, and use them for purposes such as improving the quality of the Services, making them easier to use, remembering your preferences, and serving adverts. Third-party advertisers and service providers may also use, place or read cookies or other technologies on your device, and those practices are subject to their own policies.
There are two broad types of cookies: essential and non-essential. Essential cookies are used to distinguish you from other users and to operate a website properly.
We may also use other similar technologies, including:
- web beacons, which may allow us to know whether a page was visited or an email opened;
- advertising identifiers such as the IDFA and GAID, which are connected to your device and can be reset there;
- tracking pixels, which may allow us or our advertising partners to advertise more effectively by recognising your devices across different services and platforms and identifying the source of a new installation; and
- local storage and similar mechanisms, which may help us reduce fraud, remember your in-game preferences and speed up load times.
Our games are apps rather than web pages, and they generally rely on device identifiers and software development kits rather than browser cookies. These are similar technologies serving similar purposes, and the opt-outs described above apply to them.
You can block or delete cookies through your browser settings, or use third-party plugins to warn you about attempts to place cookies on your device or to limit the types you allow. Where a website of ours uses non-essential cookies and the law requires it, you will be able to set your preferences through a cookie banner or a settings link. Please note that if you disable cookies you may lose some features and functionality.
Where a game uses precise location, it will ask for your permission through your device before doing so, and you can withdraw that permission in your device settings at any time. Otherwise we generally derive only an approximate, city- or country-level location from your IP address.
Automated Decision-Making and Artificial Intelligence
We may use technologies that (a) may be considered automated decision-making or profiling, and/or (b) include the processing of information as part of the training, testing and use of artificial intelligence and machine learning, to evaluate information that we collect — including, for example, in-game activity and communications within the Services. We may do this to operate, improve and secure the Services, to moderate content and keep players safe, to support players, to tailor the Services to your preferences, to provide new features, and for other legitimate business purposes.
Our advertising partners use automated systems to decide which advert to show you, and our analytics partners use automated systems to group usage into segments and to detect unusual or fraudulent activity. That is profiling in the sense the GDPR uses the word.
We do not make any decision about you that produces legal effects concerning you, or similarly significantly affects you, based solely on automated processing.
Your Rights
Depending on where you live and where you access our Services from, you may have some or all of the following rights in relation to the information we hold about you, and you can exercise them at any time using the details in the Contact Us section below. These are the rights the EU and UK GDPR give; comparable rights exist in Israel and in a number of other countries. Not all countries give you the same rights, and there are times when we may be entitled to refuse a request.
- Access — to be told whether we hold information about you and, if we do, to receive a copy of it together with information about how we use it. Residents of California also have the right to know the categories of information we have collected, the categories of sources, the business or commercial purposes for collecting, selling or sharing it, and the categories of third parties to whom it has been disclosed.
- Rectification or correction — to have inaccurate information corrected and incomplete information completed.
- Erasure or deletion — to have your information deleted where one of the grounds in the law applies.
- Restriction — to have our processing of your information restricted in certain circumstances, for example while we check whether it is accurate.
- Portability — to receive information you provided to us in a structured, commonly used, machine-readable format, and to have it transmitted to another controller where that is technically feasible.
- Objection — to object to processing we carry out on the basis of legitimate interests, on grounds relating to your particular situation, and to object at any time to processing for direct marketing, including profiling for advertising.
- Withdrawal of consent — to withdraw any consent you have given, at any time. Withdrawing consent does not affect the lawfulness of what we did before you withdrew it.
- Complaint to a supervisory authority — to lodge a complaint with the data protection supervisory authority in your country of residence, place of work, or the place where you think something went wrong. In Israel, that is the Privacy Protection Authority. We would appreciate the chance to address your concern first.
To exercise any of these rights, write to support@deepmist.com. We will respond within the time the law allows — one month under the GDPR, which we may extend by two further months for complex requests, telling you if we do.
Before we comply with a request, we may ask for information, documents or other evidence to confirm your identity. We operate on this basis to prevent the fraudulent, malicious or otherwise adverse disclosure, deletion or alteration of information. Where a game has no account, we may hold little that identifies you as a person, and we may need your advertising identifier or other information that lets us locate the relevant records. If we genuinely cannot identify you from what we hold, we will tell you so, and we are not required to collect more information simply to be able to comply. Some jurisdictions allow you to submit a request through an authorised agent acting on your behalf; we may require agents to provide verification that they are acting for you.
There is no charge for making a request. We may charge a reasonable fee, or refuse to act, if a request is manifestly unfounded or excessive, and we will explain why if we do.
